(1) For the purpose of staff adjustment in accordance with this Act, the organization structure and staff positions required for service delivery at the federal, state and local levels shall be as approved by the Government of Nepal.
(2) According to sub-section (1) there will be an Organization and Management Survey Committee as follows in the Ministry to make recommendations for approving the organization structure and staff positions :-
( a) Secretary, Ministry - Coordinator (b) Joint Secretary, Office of the Prime Minister and Council of Ministers - Member (c) Joint Secretary, Government of Nepal, Ministry of Finance - Member (d) Joint Secretary, Government of Nepal, Ministry of Law, Justice and Parliamentary Affairs - Member p>
(e) Joint Secretary, Government of Nepal, concerned Ministrysp; - Member
(f) Joint Secretary, Ministry
(4) Based on the list of rights according to the constitution, work nature and workload, the committee will review and recommend to the ministry if there is a need to review the organizational structure and staff positions of the federation, state and local levels approved by the Government of Nepal.
(5) The committee will recommend that when reviewing the organizational structure and staff positions at the provincial and local levels in accordance with sub-section (4) that the level positions are maintained.
(6) Sub-section (4) and Based on the recommendation of the committee as per (5), the ministry will submit to the Government of Nepal for approval the organization structure and staff positions at the federal, state and local levels. may invite the chief secretary of the province.
(8) Notwithstanding anything written in sub-section (6), if the review according to sub-section (4) does not change the organizational structure and positions existing at the time of commencement of this Act, Nepal It does not have to be submitted to the government.
(9) The committee may invite any person or form a sub-committee as needed to assist in its work.
(10) After the staff adjustment work is completed. The provincial government or the local level can increase, decrease, change or modify the organizational structure or posts as per the need. Requested by the concerned province or local levelThe Government of Nepal will provide the necessary support. (11) After the completion of the staff adjustment, the Government of Nepal will review the organizational structure and staffing of the agencies under the Union based on the list of rights mentioned in the schedule of the Constitution.
